بعد الاطلاع على النظام الأساسي للدولة الصادر بالمرسوم السلطاني رقم ١٠١ / ٩٦،
وعلى اتفاق المساعدة الأساسي النمطي بين حكومة سلطنة عمان وبرنامج الأمم المتحدة الإنمائي الموقع بتاريخ ١٩ يناير ١٩٧٤م،
وعلى الاتفاق التكميلي المنقح بشأن تقديم مساعدة تقنية لحكومة سلطنة عمان من جانب الوكالة الدولية للطاقة الذرية الموقع بتاريخ ٢٠ / ٩ / ٢٠١٠م،
وبناء على ما تقتضيه المصلحة العامة.

المادة الأولى

التصديق على الاتفاق التكميلي المنقح بشأن تقديم مساعدة تقنية لحكومة سلطنة عمان من جانب الوكالة الدولية للطاقة الذرية المشار إليه.

المادة الثانية

ينشر هذا المرسوم في الجريدة الرسمية، ويعمل به من تاريخ صدوره.

الاتفاق التكميلي المنقح بشأن تقديم مساعدة تقنية لحكومة سلطنة عمان من جانب الوكالة الدولية للطاقة الذرية

إن الوكالة الدولية للطاقة الذرية (ستدعى فيما يلي “الوكالة”) وحكومة سلطنة عمان (ستدعى فيما يلي “الحكومة”) تعقدان بموجب هذه الوثيقة الاتفاق التالي بشأن تقديم المساعدة التقنية للحكومة من جانب الوكالة أو عن طريقها.

المادة الأولى
اتفاق المساعدة الأساسي النمطي

تطبق الحكومة والوكالة على المساعدة التقنية التي تقدم للحكومة من جانب الوكالة أو عن طريقها الأحكام المنصوص عليها في اتفاق المساعدة الأساسي النمطي المعقود في ١٩ كانون الثاني / يناير ١٩٧٤م بين الحكومة وبرنامج الأمم المتحدة الإنمائي.

المادة الثانية
معايير وتدابير الأمان

تطبق الحكومة على العمليات التي تستخدم المساعدة التقنية التي تقدم لها بمقتضى هذا الاتفاق، معايير وتدابير الأمان الصادرة عن الوكالة، المحددة في الوثيقة INFCIRC/18/Rev.1، ومعايير الأمان المعمول بها كما وضعت وفقا للوثيقة المذكورة وحسب التنقيحات التي قد تجري عليها من وقت إلى آخر.

المادة الثالثة
التعهد بالاستخدام السلمي وضماناته

١- تتعهد الحكومة بألا تستخدم المساعدة التقنية التي تتلقاها بمقتضى هذا الاتفاق إلا في التطبيقات السلمية للطاقة الذرية وألا يجري، على وجه الخصوص، استخدام هذه المساعدة في صنع أسلحة نووية، وفي تعزيز أي غرض عسكري، وفي استخدامات يمكن أن تساهم في انتشار الأسلحة النووية، مثل إجراء بحوث على أجهزة تفجيرية نووية، أو تطوير هذه الأجهزة أو اختبارها أو صنعها.

٢- تحقيقا لهذه الغاية وبقدر ما يتطلبه مجلس محافظي الوكالة، تنفذ وتستوفى الحقوق والمسؤوليات الرقابية التابعة للوكالة، المنصوص عليها في الفقرة (أ) من المادة الثانية عشرة من نظام الوكالة الأساسي، فيما يخص أي مشروع يخضع لهذا الاتفاق، بمقتضى اتفاق ضمانات سار دخل حيز التنفيذ بين الحكومة والوكالة، أو – في حالة عدم وجود اتفاق كهذا – بمقتضى اتفاق ضمانات يتم عقده بين الحكومة والوكالة قبل تنفيذ المساعدة المعتمدة للمشروع.

المادة الرابعة
الحماية المادية

تتخذ الحكومة، بالقدر المناسب، جميع التدابير اللازمة لتوفير الحماية المادية للمرافق والمعدات والمواد النووية المتعلقة بصورة مباشرة بالمساعدة التقنية التي تقدم من جانب الوكالة أو عن طريقها. وتسترشد الحكومة في هذا الصدد بتوصيات الوكالة المنصوص عليها في الوثيقة INFCIRC/225/Rev.4 وحسب التنقيحات التي قد تجري عليها من وقت إلى آخر.

المادة الخامسة
ملكية المعدات أو المواد

١- تؤول إلى الحكومة ملكية المعدات والمواد التي توفر للحكومة من جانب الوكالة أو عن طريقها فيما يتعلق بأي مشروع يخضع لهذا الاتفاق وذلك فور قيام مكتب الجمارك في ميناء الدخول في سلطنة عمان بتسليمها إلى المرسل إليه أو إلى ممثل الحكومة المصرح له – حسب الأصول – حق المطالبة بالمعدات / المواد نيابة عن المشروع.

٢- فور انتقال ملكية المعدات والمواد على هذا النحو، يترتب على الحكومة ما يلي:

أ- وجوب تحمل المسؤولية التامة والحصرية وكذلك كل المسؤوليات القانونية المترتبة على مناولة هذه المعدات والمواد واستخدامها وصيانتها وخزنها والتخلص منها.

ب- والتعهد بما يلي:

١- أن تكفل التشغيل الملائم والصيانة الوافية للمعدات.

٢- وأن تتيح استخدام المعدات من قبل أي خبير يوفر من جانب الوكالة أو عن طريقها حسب المتطلبات التي قد يقتضيها أداؤه لواجباته المهنية.

٣- وأن تعمل، بالقدر المناسب، على إخضاع استخدام المعدات والمواد لأحكام المادة الثالثة من هذا الاتفاق.

المادة السادسة
تسوية المنازعات

أي نزاع بشأن تفسير هذا الاتفاق أو تطبيقه تتعذر تسويته بالتفاوض أو بطريقة أخرى متفق عليها في تسوية المنازعات، يحال بناء على طلب أي من طرفي هذا الاتفاق، إلى التحكيم. ويعين كل طرف حكما واحدا، وينتخب الحكمان المعينان على هذا النحو حكما ثالثا يكون هو رئيس المحكمة. فإذا لم يقم أي طرف في غضون ثلاثين يوما من طلب التحكيم بتعيين حكم أو لم يتم خلال خمسة عشر يوما من تعيين ثاني الحكمين انتخاب الحكم الثالث، جاز لأي طرف أن يرجو من الأمين العام للأمم المتحدة أن يعين حكما. ويكتمل النصاب القانوني بأغلبية أعضاء المحكمة التحكيمية، وتتخذ جميع القرارات بأغلبية الأصوات، والحكام هم الذين يحددون إجراءات التحكيم، ويتحمل الطرفان نفقات التحكيم حسبما يقدرها الحكام. ويتضمن قرار التحكيم بيانا يحدد الأسباب التي بني عليها ويكون هذا القرار مقبولا لدى الطرفين باعتباره الحكم النهائي الفاصل في النزاع.

المادة السابعة
بدء النفاذ

يبدأ نفاذ هذا الاتفاق عند توقيعه من جانب ممثل الحكومة المخول حق التوقيع ومن جانب المدير العام للوكالة أو من ينوب عنه. ويكون تاريخ بدء نفاذ هذا الاتفاق هو تاريخ التوقيع الأخير.

تحرر من نسختين باللغة العربية واللغة الانكليزية، علما بأن النصين متساويان في الحجية.

REVISED SUPPLEMENTARY AGREEMENT CONCERNING THE PROVISION OF TECHNICAL ASSISTANCE BY THE INTERNATIONAL ATOMIC ENERGY AGENCY TO THE GOVERNMENT OF THE SULTANATE OF OMAN

THE INTERNATIONAL ATOMIC ENERGY AGENCY (hereinafter called the “Agency”) and THE GOVERNMENT OF THE SULTANATE OF OMAN (hereinafter called the “Government”) hereby enter into this Agreement concerning the provision of technical assistance to the Government by or through the Agency.

ARTICLE I
Standard Basic Assistance Agreement

The Government and the Agency shall apply to the technical assistance provided to the Government by or through the Agency the provisions of the Standard Basic Assistance Agreement concluded on 19 January 1974 between the Government and the United Nations Development Programme.

ARTICLE II
Safety Standards and Measures

The Government shall apply to the operations making use of the technical assistance provided to it pursuant to this Agreement the Agency’s Safety Standards and Measures defined in document INFCIRC/18/Rev.1 and the applicable safety standards as they are established in accordance with that document and as they may be revised from time to time.

ARTICLE III
Peaceful Use Undertaking and Safeguards

1. The Government undertakes that the technical assistance it receives pursuant to this Agreement shall be used only for peaceful applications of atomic energy and, in particular, that such assistance shall not be used for the manufacture of nuclear weapons, for the furtherance of any military purpose and for uses which could contribute to the proliferation of nuclear weapons, such as research on, development, testing or manufacture of a nuclear explosive device.

2. To this end and to the extent required by the Board of Governors of the Agency, the Agency’s safeguards rights and responsibilities provided for in Paragraph A of Article XII of its Statute shall be implemented and maintained with respect to a project subject to this Agreement pursuant to an applicable safeguards agreement which is in force between the Government and the Agency or, in the absence of such an agreement, pursuant to a safeguards agreement to be concluded between the Government and the Agency prior to the implementation of the assistance approved for the project.

ARTICLE IV
Physical Protection

To the extent relevant, the Government shall take all the measures necessary for the physical protection of nuclear facilities, equipment and materials relating directly to the technical assistance provided by or through the Agency. The Government shall be guided by the recommendations of the Agency set forth in document INFCIRC/225/Rev.4 and as they may be revised from time to time.

ARTICLE V
Title to Equipment or Materials

1. Title to the equipment and materials provided to the Government by or through the Agency in relation to a project subject to this Agreement shall vest in the Government upon the release of the equipment and materials from the customs office at the port of entry in the Sultanate of Oman to the consignee or the representative of the Government duly authorized to claim the equipment / materials on behalf of the project.

2. Upon such transfer of title to the equipment and materials, the Government:

(a) shall assume full and exclusive responsibility and all liabilities for the handling, use, maintenance, storage and disposal of such equipment and materials;

(b) undertakes that:

(i) it shall ensure the proper operation and adequate maintenance of the equipment;

(ii) the equipment shall be made available for use by any expert provided by or through the Agency as may be required for the discharge of his professional duties; and

(iii) to the extent relevant, the use of the equipment and materials shall be subject to the provisions of Article III of this Agreement.

ARTICLE VI
Settlement of Disputes

Any dispute concerning the interpretation or application of this Agreement which cannot be settled by negotiation or another agreed mode of settlement shall be submitted to arbitration at the request of either Party to this Agreement. Each Party shall appoint one arbitrator, and the two arbitrators so appointed shall elect a third, who shall be the Chairman.
If within thirty days of the request for arbitration either Party has not appointed an arbitrator or within fifteen days of the appointment of the second arbitrator the third arbitrator has not been elected, either Party may request the Secretary General of the United Nations to appoint an arbitrator. A majority of the members of the arbitral tribunal shall constitute a quorum, and all decisions shall be made by majority vote. The arbitral procedure shall be established by the arbitrators, and the expenses of the arbitration shall be borne by the Parties as assessed by the arbitrators. The arbitral award shall contain a statement of the reasons on which it is based and shall be accepted by the Parties as the final adjudication of the dispute.

ARTICLE VII
Entry into Force

This Agreement shall enter into force upon signature by the authorized representative of the Government and by or fore the Director General of the Agency. The date of entry into force shall be the date of the last signature.
