بعد الاطلاع على النظام الأساسي للدولة الصادر بالمرسوم السلطاني رقم ١٠١ / ٩٦،
وعلى الاتفاقية بين حكومة سلطنة عمان وحكومة جمهورية جنوب أفريقيا حول منتدى الشراكة الموقعة بمدينة كيب تاون بتاريخ ٢٨ أكتوبر ٢٠١٠م،
وبناء على ما تقتضيه المصلحة العامة.
رسمنا بما هو آت
المادة الأولى
التصديق على الاتفاقية المشار إليها وفقا للصيغة المرفقة.
المادة الثانية
ينشر هذا المرسوم في الجريدة الرسمية، ويعمل به من تاريخ صدوره.
صدر في: ١٧ من رجب سنة ١٤٣٢هـ

اتفاقية بين حكومة سلطنة عمان وحكومة جمهورية جنوب أفريقيا حول منتدى الشراكة
إن حكومة سلطنة عمان وحكومة جمهورية جنوب أفريقيا (يشار إليهما أدناه مجتمعين بالطرفين ولكل منهما على حدة بالطرف).
إذ يقران برغبتهما في تعزيز العلاقات الودية القائمة بين بلديهما،
ورغبة منهما في دعم التعاون السياسي والتجاري والاقتصادي والثقافي والعلمي والفني والتكنولوجي على أساس المساواة والمصلحة المتبادلة،
وإيمانا منهما بأن إقامة هذا التعاون من شأنه أن يخدم مصلحة الطرفين المشتركة ويساهم في تعزيز التنمية الاقتصادية والاجتماعية لشعبي البلدين،
وإذ يقران أيضا بأن إقامة منتدى الشراكة العماني – الجنوب أفريقي سوف يسهم في تعزيز التعاون في المجالات المذكورة أعلاه،
فقد اتفقتا على ما يلي:
المادة الأولى
يقوم الطرفان بإنشاء منتدى الشراكة العماني – الجنوب أفريقي (يشار إليه أدناه “منتدى الشراكة”).
المادة الثانية
يسعى منتدى الشراكة من أجل تحقيق ما يلي:
أ- دعم وتقوية وتطوير التعاون بين الطرفين في المجالات السياسية والتجارية والاقتصادية والثقافية والعلمية والتقنية والتكنولوجية.
ب- دراسة إمكانية إبرام اتفاقيات ثنائية وبرامج تنفيذية خاصة لتنفيذ هذه الاتفاقية.
ج- دعم المشروعات المشتركة ومبادرات القطاع الخاص مع وضع مميزات وقدرات كل طرف في الاعتبار.
المادة الثالثة
١- تعقد اجتماعات منتدى الشراكة على مستوى الوزير المسؤول عن الشؤون الخارجية العماني، ووزير العلاقات الدولية والتعاون الجنوب أفريقي، وعلي مستوى كبار المسؤولين أو ممثليهم المفوضين.
٢- يرأس اجتماعات منتدى الشراكة الوزيران المشار إليهما أعلاه أو ممثلوهم المخولون بذلك.
المادة الرابعة
يمكن لاجتماعات كبار المسؤولين دراسة قضايا محددة والتقدم بتوصيات مناسبة تتعلق بالقضايا المطروحة على جدول أعمال منتدى الشراكة، كما يقوم الطرفان بتحديد مقار ومواعيد تلك الاجتماعات.
المادة الخامسة
١- يجتمع منتدى الشراكة، حسب الاتفاق، بناء على طلب أي من الطرفين بالتناوب في جمهورية جنوب أفريقيا وفي سلطنة عمان أو في أي مكان آخر يتفق عليه الطرفان.
٢- يعقد منتدى الشراكة اجتماعاته وفقا لجدول الأعمال المتفق عليه وحسب الاتفاق بين رئيسي الاجتماع، كما يحدد المنتدى كافة القواعد الإجرائية الخاصة به.
٣- يوفر الطرف المستضيف مقر الاجتماع وكافة خدمات السكرتارية.
٤- يتحمل كل طرف كافة التكاليف المتعلقة بحضور وفده إلى اجتماعات المنتدى.
المادة السادسة
يتم تسوية أي نزاع ينشأ بين الطرفين حول تفسير هذا الاتفاق وتطبيقه بالطرق الودية وعبر التشاور أو التفاوض بين الطرفين.
المادة السابعة
يخضع التعاون بين الطرفين في إطار هذا الاتفاق للقوانين الداخلية السارية في البلدين.
المادة الثامنة
يمكن تعديل هذه الاتفاقية بموافقة الطرفين من خلال تبادل المذكرات بين الطرفين عبر القنوات الدبلوماسية.
المادة التاسعة
١- تدخل هذه الاتفاقية حيز التنفيذ في اليوم والتاريخ الذي يبلغ فيه كل طرف الطرف الآخر كتابيا ومن خلال القنوات الدبلوماسية بأنه قام باتخاذ كافة الإجراءات القانونية اللازمة لتنفيذها. يبدأ سريان الاتفاقية من تاريخ الإخطار الأخير بذلك.
٢- يستمر سريان هذه الاتفاقية لمدة خمس سنوات وتجدد تلقائيا لمدد مماثلة، ما لم يبلغ أي من الطرفين الطرف الآخر كتابيا عن طريق القنوات الدبلوماسية بنيته في إنهاء الاتفاقية قبل انتهائها بستة أشهر على الأقل.
وإثباتا لما تقدم وقع المفوضان بالتوقيع نيابة عن حكومتي سلطنة عمان وجمهورية جنوب أفريقيا على نسختين باللغة العربية والإنجليزية من هذه الاتفاقية وتتمتع كل من النسختين بالحجية القانونية.
وقعت هذه الاتفاقية في مدينة كيب تاون في يوم الخميس الموافق ٢٨ / ١٠ / ٢٠١٠م.

Agreement Between The Government of the Sultanate of Oman And The Government of the Republic of South Africa On The Establishment of A Partnership Forum
The Government of the Sultanate of Oman and the Government of the Republic of South Africa (hereinafter jointly referred to as the “Parties” and separately as a “Party”).
Recognizing their desire to strengthen the existing friendly relations between the two countries;
Desiring to promote political, trade, economic, cultural, scientific, technical and technological cooperation on the basis of equality and mutual benefit;
Believing that the establishment of such cooperation would serve their common interest and contribute to the enhancement of economic and social development of the peoples of both countries;
Further recognizing that the establishment of the “Omani – South African Partnership Forum” will contribute in furthering cooperation in the above fields;
HAVE AGREED as follows:
Article 1
The Parties hereby establish the Omani – South African Partnership Forum (hereinafter referred to as the “Partnership Forum”).
Article 2
The Partnership Forum shall endeavour to:
a- advance, strengthen and develop cooperation between the Parties in the political, trade, economic, cultural, scientific, technical and technological fields;
b- study the possibility of concluding bilateral agreements and executive programmes in order to implement this Agreement; and
c- promote joint ventures and private sector initiatives taking into account the advantages as well as the comparative capabilities of each Party.
Article 3
1- Meetings of the Partnership Forum shall be held at the level of Minister Responsible for Foreign Affairs on the side of the Sultanate of Oman, and the Minister of international Relations and Cooperation on the side of the Republic of South Africa, and on the level of senior officials or their designated representatives.
2- Meetings of the Partnership Forum shall be jointly chaired by the Ministers mentioned above or their designated representatives.
Article 4
Meetings at the level of senior officials can consider specific issues and make appropriate recommendations relating to the issues on the agenda of the Partnership Forum. The venue and time of such meetings shall be determined by the Parties.
Article 5
1- The Partnership Forum shall meet, subject to agreement, at the request of either Party alternatively in the Republic of South Africa and the Sultanate of Oman or another agreed venue.
2- The Partnership Forum shall conduct its meetings as per the approved agenda and as agreed between the chairpersons and shall determine its own procedures.
3- The Party hosting the meeting shall provide the venue and all secretarial services.
4- Each Party shall bear the costs related to the attendance of meetings by its delegation.
Article 6
Any dispute between the Parties arising out of the interpretation and application of this Agreement shall be settled amicably through consultation or negotiations between the Parties.
Article 7
Cooperation between the Parties within the framework of this Agreement shall be governed by the domestic law in force in both countries.
Article 8
This Agreement may be amended by mutual consent of the Parties through an Exchange of Notes between the Parties through the diplomatic channels.
Article 9
1- This Agreement shall enter into force on the date on which each Party has notified the other in writing through the diplomatic channels, that it has taken the legal measures necessary for the implementation thereof, the date of entry into force shall be the date of the last notification.
2- This Agreement shall remain in force for a period of five years, where after it shall be renewed automatically for further periods of five years at a time, unless terminated by either Party by giving at least six months’ written notification in advance to the other Party through the diplomatic channels of its intention to terminate this Agreement.
IN WITNESS WHEREOF the undersigned, being duly authorized by their respective Governments, have signed and sealed this Agreement in two originals in the English and Arabic languages, all texts being equally authentic.
DONE at Cape Town on this Thursday of 28 / 10 / 2010.
