بعد الاطلاع على النظام الأساسي للدولة،
وعلى الاتفاقية بين حكومة سلطنة عمان، وحكومة النيبال حول الإعفاء المتبادل من متطلبات التأشيرة لحاملي جوازات السفر الدبلوماسية والخاصة والخدمة والرسمية الموقعة في مدينة مسقط بتاريخ ١٩ من أكتوبر ٢٠٢٠م،
وبناء على ما تقتضيه المصلحة العامة.

التصديق على الاتفاقية المشار إليها، وفقا للصيغة المرفقة.

المادة الثانية

ينشر هذا المرسوم في الجريدة الرسمية، ويعمل به من تاريخ صدوره.

اتفاقية بين حكومة سلطنة عمان وحكومة النيبال حول الإعفاء المتبادل من متطلبات التأشيرة لحاملي جوازات السفر الدبلوماسية والخاصة والخدمة والرسمية

إن حكومة سلطنة عمان، وحكومة النيبال، (والمشار إليهما أدناه بـ “الطرفين”، ولأحدهما منفردا بـ “الطرف”)،

رغبة منهما في تقوية علاقات الصداقة بين البلدين،

وإذ تحدوهما الرغبة في تسهيل سفر مواطنيهما، حاملي جوازات السفر الدبلوماسية والخاصة والخدمة والرسمية السارية المفعول في إقليم الطرف الآخر،

وإدراكا منهما بأن التعاون في هذه الاتفاقية يستند إلى مبدأ المساواة، والمعاملة بالمثل.

فقد توصلا إلى الآتي:

المادة (١)

تطبق أحكام هذه الاتفاقية على حاملي أي من جوازات السفر الآتية:

١ – جوازات السفر الدبلوماسية والخاصة والخدمة، سارية المفعول التابعة لحكومة سلطنة عمان.

٢- جوازات السفر الدبلوماسية والرسمية، سارية المفعول التابعة لحكومة النيبال.

المادة (٢)

يجوز لمواطني أي من الطرفين، حاملي أي من جوازات السفر المشار إليها في المادة (١)، الدخول إلى والبقاء في والمرور عبر والخروج من إقليم الطرف الآخر دون شرط الحصول على التأشيرة لمدة لا تتجاوز (٩٠) تسعين يوما من تاريخ الدخول لكل مرة.

المادة (٣)

يجب على مواطني أي من الطرفين حاملي أي من جوازات السفر السارية المشار إليها في المادة (١) عدم القيام بأي أنشطة مدفوعة الأجر التي تتطلب تصريح عمل في أثناء إقامتهم في إقليم الطرف الآخر.

المادة (٤)

يجب على مواطني أي من الطرفين حاملي أي من جوازات السفر السارية المشار إليها في المادة (١) الالتزام بالقوانين والأنظمة المعمول بها في أثناء إقامتهم في إقليم الطرف الآخر.

المادة (٥)

يجب أن تكون جوازات السفر المشار إليها في المادة (١)، والخاصة بمواطني أي من الطرفين، سارية المفعول لمدة (٦) ستة أشهر على الأقل عند دخولهم إلى إقليم الطرف الآخر.

المادة (٦)

يجب على مواطني أي من الطرفين حاملي أي من جوازات السفر السارية المشار إليها في المادة (١) الدخول إلى، والمرور عبر والخروج من إقليم الطرف الآخر من خلال نقاط عبور الحدود المخصصة للمنافذ الدولية، ودون أي قيود، وذلك باستثناء قيود الدخول المتعلقة بالأمن والجمارك والهجرة والصحة، أو أي أحكام أخرى مطبقة قانونيا على حاملي هذه الجوازات.

المادة (٧)

١ – يعفى مواطنو أي من الطرفين حاملي أي من جوازات السفر السارية المشار إليها في المادة (١)، الذين يتم تعيينهم في بعثة دبلوماسية أو قنصلية أو في منظمة دولية في إقليم الطرف الآخر، من شرط الحصول على تأشيرة قبل دخولهم إقليم الطرف الآخر.

٢ – تمتد المعاملة المشار إليها في الفقرة (١) من هذه المادة لتشمل أفراد عائلات المواطنين المشار إليهم أعلاه الذين يقيمون معهم في المنزل نفسه، شريطة أن يكونوا حاملي أي من جوازات السفر المشار إليها في المادة (١).

٣ – يجب على وزارة الخارجية في الطرف الآخر اعتماد المواطنين المشار إليهم في الفقرتين (١) و(٢) من هذه المادة خلال (٣٠) ثلاثين يوما من دخولهم الأول إلى إقليم الطرف الآخر، وبناء على ذلك يتم منحهم التأشيرات الخاصة بهم وفقا للأنظمة الوطنية المعمول بها لدى الطرف الآخر.

المادة (٨)

١ – لا تؤثر هذه الاتفاقية على حق السلطات المختصة لأي من الطرفين في رفض دخول مواطني الطرف الآخر، حاملي أي من جوازات السفر السارية المشار إليها في المادة (١) إلى إقليم كل منهما أو تقصير مدة إقامتهم أو إنهائها، وذلك في حالة اعتبار المواطنين المعنيين غير مرغوب فيهم، أو في حال تمثيلهم لخطر على الأمن الوطني أو النظام العام، أو الصحة العامة، أو عندما يكون وجودهم في إقليم الدولة المعنية بصفة غير قانونية.

٢ – في حالة تأثر أحد مواطني الطرف الآخر بموجب أحكام هذه المادة، يتوجب على الطرف المسؤول عن الإجراء آنف الذكر إخطار الطرف الآخر كتابة عبر القنوات الدبلوماسية دون تأخير.

المادة (٩)

١ – في حالة فقدان أو سرقة أو تلف أو بطلان صلاحية أي من جوازات السفر المشار إليها في المادة (١) لمواطن أي من الطرفين في إقليم الطرف الآخر، تقدم له البعثة الدبلوماسية أو القنصلية، التي ينتمي إليها صاحب الجواز المعني، الوثائق التي تمكنه من العودة إلى الإقليم الذي ينتمي إليه.

٢ – يجب على البعثة الدبلوماسية أو القنصلية آنفة الذكر إبلاغ الجهات المختصة لدى الطرف الآخر على الفور عن مثل هذه الحوادث عبر القنوات الدبلوماسية.

المادة (١٠)

١ – يتبادل الطرفان نماذج من جوازات السفر المشار إليها في المادة (١) عبر القنوات الدبلوماسية خلال (٣٠) ثلاثين يوما من تاريخ التوقيع على هذه الاتفاقية.

٢ – في حالة حدوث أي تغيير على الجوازات المشار إليها في المادة (١)، يتعين على الطرف الذي تم تغيير جوازاته توفير نماذج من الجوازات المعدلة إلى الطرف الآخر عبر القنوات الدبلوماسية خلال (٣٠) ثلاثين يوما قبل دخول هذا التغيير حيز التنفيذ.

المادة (١١)

يجوز للطرفين تعديل أو مراجعة أحكام هذه الاتفاقية بموافقتهما كتابة عبر القنوات الدبلوماسية، وأي تعديلات أو تغييرات يتفق عليها الطرفان تدخل حيز التنفيذ طبقا للمادة (١٦) من هذه الاتفاقية، وتكون جزءا لا يتجزأ منها.

المادة (١٢)

لا تؤثر هذه الاتفاقية على الالتزامات الأخرى المترتبة على الطرفين بموجب الاتفاقيات الدولية، أو أي اتفاقيات ثنائية مبرمة بين البلدين.

المادة (١٣)

يعمل الطرفان بهذه الاتفاقية طبقا للقوانين والأنظمة المعمول بها في كل من البلدين.

المادة (١٤)

يسوي الطرفان أي خلاف ينشأ عن تنفيذ أو تفسير أحكام هذه الاتفاقية وديا من خلال المشاورات عبر القنوات الدبلوماسية.

المادة (١٥)

١ – يجوز لأي من الطرفين تعليق العمل بهذه الاتفاقية مؤقتا، بشكل كلي أو جزئي، لأسباب تتعلق بالأمن الوطني أو النظام العام أو الصحة العامة، أو في حال مخالفة أحكام هذه الاتفاقية.

٢ – يجب على الطرف الذي يرغب في تعليق العمل بهذه الاتفاقية إخطار الطرف الآخر عن التعليق مع بيان أسبابه كتابة عبر القنوات الدبلوماسية قبل (٧) سبعة أيام على الأقل من دخول هذا التعليق حيز التنفيذ، كما أن عليه إخطار الطرف الآخر بانتهاء مدة التعليق كتابة عبر القنوات الدبلوماسية قبل (٧) سبعة أيام على الأقل من إنهاء هذا التعليق.

٣ – لا يؤثر تعليق العمل بهذه الاتفاقية على الوضع القانوني لمواطني أي من الطرفين حاملي أي من جوازات السفر السارية المشار إليها في المادة (١) الذين دخلوا مسبقا إقليم الطرف الآخر.

المادة (١٦)

تدخل هذه الاتفاقية حيز التنفيذ بعد (٦٠) ستين يوما من تسلم آخر إخطار، عبر القنوات الدبلوماسية، من أحد الطرفين يبلغ فيه الطرف الآخر بإكمال إجراءاته الداخلية اللازمة لدخول الاتفاقية حيز التنفيذ، وتسري الاتفاقية لمدة غير محددة ما لم يخطر أحد الطرفين الطرف الآخر كتابة، وعبر القنوات الدبلوماسية، عن رغبته في إنهائها قبل (٦٠) ستين يوما على الأقل من إنهائها.

وقعت هذه الاتفاقية في مسقط في يوم الإثنين بتاريخ ١٩ أكتوبر ٢٠٢٠م، من نسختين أصليتين باللغات العربية، والنيبالية، والإنجليزية، لكل منها ذات الحجية القانونية، وفي حالة الاختلاف في التفسير يعتد بالنص الإنجليزي.

AGREEMENT BETWEEN THE GOVERNMENT OF THE SULTANATE OF OMAN AND THE GOVERNMENT OF NEPAL ON MUTUAL VISA EXEMPTION FOR HOLDERS OF DIPLOMATIC,SPECIAL, SERVICE AND OFFICIAL PASSPORTS

The Government of the Sultanate of Oman and the Government of Nepal, (hereinafter referred to as the ‘Parties’ and singularly as the ‘Party’);

Desiring to strengthen the friendly relations between the countries;

Wishing to facilitate the travel of their nationals, holders of valid diplomatic, special, service and official passports into the territory of the other Party;

Recognizing that co-operation within this Agreement is based on the principles of equality and reciprocity;

Have reached the following:

Article 1

The provisions of this Agreement apply to holders of any of the following passports:

1. Valid diplomatic, special and service passports of the Government of the Sultanate of Oman.

2. Valid diplomatic and official passports of the Government of Nepal.

Article 2

Nationals of either Party, holders of any of the passports mentioned in Article 1, may enter into, stay in, transit through, and exit from the territory of the other Party without the requirement of obtaining a visa for a period not exceeding ninety (90) days from the date of each entry.

Article 3

Nationals of either Party, holders of any of the valid passports mentioned in Article 1, must not undertake any paid-activity that requires a work permit during their stay in the territory of the other Party.

Article 4

Nationals of either Party, holders of any of the passports mentioned in Article 1, shall abide by the laws and regulations in force during their stay in the territory of the other Party.

Article 5

The passports mentioned in Article 1, belonging to Nationals of either Party, shall be valid for a period of at least six (6) months on their entry into the territory of the other Party.

Article 6

Nationals of either Party, holders of any of the passports mentioned in Article 1, shall enter into, transit through, and exit from the territory of the other Party through the border-crossing points open to international traffic without any restriction, except for entry restrictions relating to security, customs, immigration, and health, or any other provisions legally applicable to the holders of these passports.

Article 7

1. Nationals of either Party, holders of any of the passports mentioned in Article 1, who are appointed to a diplomatic or consular mission or international organization in the territory of the other Party, shall be exempted from obtaining a visa prior to their entry into the territory of the other Party.

2. The treatment referred to in paragraph 1 of this article shall also extend to members of the families of the aforesaid nationals who live with them in the same household, provided that they are holders of any of the passports mentioned in Article 1.

3. The Ministry of Foreign Affairs of the other Party shall accredit the nationals referred to in paragraphs 1 and 2 of this Article within thirty (30) days from their entry into the territory of the other Party, upon which they will be granted their respective visas in accordance with the applicable national regulations of the other Party.

Article 8

1. This Agreement does not affect the fight of the competent authorities of either Party to refuse entry of the nationals of the other Party, holders of any of the passports mentioned in Article 1, into their respective State territories, reduce their period of stay or terminate it, where the nationals in question are considered non grata or where they may present a risk to the national security, public order or public health, or where their presence within the respective territory is illegal.

2. Where a national of the other Party has been affected by the provisions of this Article, the Party responsible for the aforementioned action must notify the other Party in writing through diplomatic channels without delay.

Article 9

1. In the case of loss, theft, damage or invalidity of any of the passports mentioned in Article 1 by a national of a Party in the territory of the other Party, the diplomatic or consular mission, to which the holder of the passport in question belongs to, shall provide him/her with the documents that enable him/her to return to the territory of the Party to which he/she is national of.

2. The aforementioned diplomatic or consular mission shall promptly notify the competent authorities of the other Party of such incidents through diplomatic channels.

Article 10

1. The Parties shall exchange specimens of the passports mentioned in Article 1, through diplomatic channels, within thirty (30) days from the date of signature of this Agreement.

2. In the case of any changes in the passports mentioned in Article 1, the Party, whose passports have been changed, shall provide specimens of the changed passports to the other Party, through diplomatic channels, thirty (30) days prior to the entry of these changes into force.

Article 11

The Parties may amend and revise the provisions of this Agreement by mutual consent in writing through diplomatic channels. Any revision or amendment shall come into effect according to Article 16 of this Agreement and shall accordingly form an integral part of it.

Article 12

This Agreement shall not prejudice any obligations of the Parties arising under international agreements, or any bilateral agreements concluded between the two countries.

Article 13

The Parties shall implement this Agreement in accordance with the laws and regulations in force in both countries.

Article 14

The Parties shall amicably settle any dispute arising out of the implementation or interpretation of the provisions of this Agreement by consultation through diplomatic channels.

Article 15

1. Either Party may temporarily suspend the application of this Agreement, completely or partially, for reasons relating to national security, public order or public health, or in case of violation of the provisions of this Agreement.

2. The Party, who wishes to suspend the application of this Agreement, shall notify the other Party of the suspension and specify the reasons thereof in writing, through diplomatic channels, at least seven (7) days before the entry of this suspension into force, and shall also inform the other Party of the end of this suspension period in writing through diplomatic channels at least seven (7) days before the end of this suspension.

3. The suspension of the application of this Agreement does not affect the legal status of the nationals of either Party, holders of any of the passports mentioned in Article 1, who have already entered into the territory of the other Party.

Article 16

This Agreement shall enter into force sixty (60) days after the receipt of the last written notification through diplomatic channels, by which one Party informs the other Party of the completion of its internal procedures required for that purpose, and the Agreement shall be valid for an indefinite period of time unless one of the Parties notifies the other Party in writing, through the diplomatic channels, of its intention to terminate it at least sixty (60) days before the application of this termination.

This Agreement is signed in Muscat on Monday, 19th of October 2020, in two originals, each in the Arabic, Nepali and English languages, all texts being equally authentic. In case of discrepancy in interpretation, the English text shall prevail.
